In 2015 Mark was designated by AAA as a "Master Mediator" on the AAA Construction Panel and was reappointed to the AAA Master Mediator Panel in 2022. In 2003, Mark was the recipient of the AAA Distinguished Service Award - the Construction Gavel. He has presented at a number of seminars on various aspects of ADR, including the use of online dispute resolution. He has instructed other ADR neutrals on the effective use of video conference platforms for both arbitration and mediation.
Mark has served as an arbitrator in hundreds of cases and has mediated more than 300 matters, including both arbitration and mediation of multi-party actions. Many have involved construction issues, primarily in disputes between owners and general contractors, but also matters involving owners and design professionals and disputes between general and subcontractors. Mark has assisted governmental entities, such as city and county government in resolution of construction and commercial disputes. He has also arbitrated and mediated all types of business disputes, including those among shareholders, partners and similar disputes among business owners.
Mark is on the panel of arbitrator chairpersons for the Cuyahoga County Common Pleas Court as well as the business mediation panel for that court. In that role he has helped resolve numerous matters involving business, commercial and construction pending in the court.
Mark became a member of the Ohio bar in 1977 and the Maryland bar in 1982. He is a member of the Ohio State Bar Association, and the current vice-chair of its Dispute Resolution Committee. He is a member of the Columbus Bar Association and its ADR Committee, and the Cleveland Metropolitan Bar Association. He served as the Chair of the Alternative Dispute Resolution Section of the CMBA from 2012 through 2020.
Mark received his undergraduate and master's degrees from the University of Michigan in 1972 and 1973 and his JD (cum laude) from The American University, Washington College of Law in 1976.
Mark was a member of the City Council of Beachwood, Ohio. After being appointed to fill a term in 1999, he was re-elected to four additional terms, through 2015, served as Council President in 2008 and 2009 and Vice-President in 2014 and 2015. He chaired the Council Legal Committee, and served as Council's representative to the Planning & Zoning Commission. He was also a member of the Council Finance and Insurance Committee and Economic Development Committee. Before his appointment to Council, Mark served on the City of Beachwood Planning & Zoning Commission in 1997 and 1998.

Mark is a member of Wachter Kurant, LLC. The firm evolved from Kurant Wachter Co. LPA and Conway, Marken & Mays, and Mays, Karberg & Wachter. Mark was an associate with A.R. Mays & Associates until becoming a partner in 1984. He was admitted to the Bar in Ohio in 1977 and in Maryland in 1982.
Mark has been an arbitrator for over 40 years and a mediator for over 35.
Mark's has practiced as civil trial lawyer for over 40 years. His practice is primarily litigation of business, construction, real estate, and commercial disputes. In construction and real estate law, Mark has represented owners, developers, general contractors, sub and specialty contractors, lenders, suppliers, manufacturers, architects, engineers and designers. Projects have included private, commercial and residential buildings. He has litigated both public and private sector projects; commercial, retail and residential construction issues; acquisition; subdivision matters; leasehold issues; boundary disputes; mechanic's lien and foreclosures.
